If a family member or friend does not have sufficient mental capacity to sign a Lasting Power of Attorney you will have to apply to the Court of Protection to be appointed as their Deputy in order to obtain the legal authority necessary to deal with their affairs. The Mental Capacity Act (MCA) 2005 applies to everyone involved in the care, treatment and support of people aged 16 and over living in England and Wales who are unable to make all or some decisions for themselves. We can prepare all the forms for you, obtain the required medical certificate, submit the application to the Court and deal with the administration after the appointment has been made.

If there is nobody in the family who wants to take on the role of Deputy we can apply to do this.
